There’s been a lot of free-floating fear and horror in the media recently about the appointment as national security adviser of John Bolton, a man who’s been itching for war(s) since the 1990s.  His approach to Iran and North Korea in particular (not quite nuke ’em!, but not that much short of it either) isn’t what you’d call either carefully calibrated or particularly diplomatic.  Still, a certain balance in reporting on Bolton has been lacking.  You can search in vain for any outlets (other than Fox News) giving President Trump the slightest credit for what he did, which was no mean trick.  After all, short of bringing former Vice President Dick Cheney out of “retirement” and making him secretary of defense (as indeed he was for President George H.W. Bush), it’s hard to think of a single former official of the George W. Bush administration -- or more or less anyone else -- who would still so vehemently defend the absolute brilliance of the invasion of Iraq and of "preemptive war.”  On that score, Bolton is as close to the last man standing as you’re likely to find and since, in his eagerness for that 2003 invasion (and his willingness to back intelligence information, no matter how false, promoting it), he was also one of the first men standing, which means he is indeed a unique candidate for the national security adviser’s job.

Unfortunately, the media (Fox News excepted) just doesn’t get the thrill of it all. Keep in mind that President Trump tried “my generals” for more than a year and what did that get him?  Deeper into Afghanistan, four dead Green Berets in Niger, stuck in Syria. Now, he’s putting the fate of the republic back in the hands of civilians (and in the process, miraculously enough, turning those hawkish generals into the true “adults” in, or presently leaving, or soon to leave the “room”).  So some civilians are about to have their moment.  Give them nine months at the outside.  Bolton, in particular, has a reputation for being acerbic and beyond blunt in his views, so don’t expect him to last long with a president who clearly must be pandered to in extreme ways by those who care to survive in office -- or in the Oval Office -- for even modest lengths of time.

Here, then, is the true thrill of it all: imagining what could possibly come next.  After the generals, the neocons, the Tea Party right, the Fox News commentators, the Islamophobes and Iranophobes of every sort -- that is, by election time 2018 -- who’s going to be left?  What pool of Martians could Donald Trump possibly choose from for his next set of appointees?  Stay tuned and, while you’re waiting, let TomDispatch regular Rebecca Gordon, author of American Nuremberg: The U.S. Officials Who Should Stand Trial for Post-9/11 War Crimes, return you to that invasion-of-Iraq moment and remind you of what a thoroughly stellar crew we’ve had running our ship of state, our own Titanic, for much of the time since.

War Crimes and War Criminals, Old and (Potentially) New

barely noticed anniversary slid by on March 20th. It’s been 15 years since the United States committed the greatest war crime of the twenty-first century: the unprovoked, aggressive invasion of Iraq. The New York Times, which didn’t exactly cover itself in glory in the run-up to that invasion, recently ran an op-ed by an Iraqi novelist living in the United States entitled “Fifteen Years Ago, America Destroyed My Country,” but that was about it. The Washington Post, another publication that (despite the recent portrayal of its Vietnam-era heroism in the movie The Post) repeatedly editorialized in favor of the invasion, marked the anniversary with a story about the war’s “murky” body count. Its piece concluded that at least 600,000 people died in the decade and a half of war, civil war, and chaos that followed -- roughly the population of Washington, D.C.

These days, there’s a significant consensus here that the Iraq invasion was a “terrible mistake,” a “tragic error,” or even the “single worst foreign policy decision in American history.” Fewer voices are saying what it really was: a war crime. In fact, that invasion fell into the very category that led the list of crimes at the Nuremberg tribunal, where high Nazi officials were tried for their actions during World War II. During the negotiations establishing that tribunal and its rules, it was (ironically, in view of later events) the United States that insisted on including the crime of “waging a war of aggression” and on placing it at the head of the list. The U.S. position was that all the rest of Germany’s war crimes sprang from this first “crime against peace.”

Similarly, the many war crimes of Dick Cheney and George W. Bush -- the extraordinary renditions; the acts of torture at Guantánamo, Bagram Air Base in Afghanistan, and CIA black sites all over the world; the nightmare of abuse at Abu Ghraib, a U.S. military prison in Iraq; the siege and firebombing (with white phosphorus) of the Iraqi city of Fallujah; the massacre of civilians in Haditha, another Iraqi city -- all of these arose from the Bush administration’s determination to invade Iraq.

It was to secure “evidence” of a (nonexistent) connection between Saddam Hussein and the al-Qaeda attackers of 9/11 that Secretary of Defense Donald Rumsfeld upped the ante at Guantánamo in his infamous memo approving torture there. The search for proof of the same connection motivated the torture of Abu Zubaydah at a CIA black site in Thailand. If not for that long-planned invasion of Iraq, the “war on terror” might have ended years ago.

But Wasn’t That Then?

Fifteen years is an eternity in what Gore Vidal once called “the United States of Amnesia.” So why resurrect the ancient history of George W. Bush in the brave new age of Donald Trump? The answer is simple enough: because the Trump administration is already happily recycling some of those Bush-era war crimes along with some of the criminals who committed them. And its top officials, military and civilian, are already threatening to generate new ones of their own.

Last July, the State Department closed the office that, since the Clinton administration, has assisted war crimes victims seeking justice in other countries. Apparently, the Trump administration sees no reason to do anything to limit the impunity of war criminals, whoever they might be. Reporting on the closure, Newsweek quoted Major Todd Pierce, who worked at Guantánamo as a judge advocate general (JAG) defense attorney, this way:

“It just makes official what has been U.S. policy since 9/11, which is that there will be no notice taken of war crimes because so many of them were being committed by our own allies, our military and intelligence officers, and our elected officials. The war crime of conspiring and waging aggressive war still exists, as torture, denial of fair trial rights, and indefinite detention are war crimes. But how embarrassing and revealing of hypocrisy would it be to charge a foreign official with war crimes such as these?”

Guantánamo JAG attorneys like Pierce are among the real, if unsung, heroes of this sorry period. They continue to advocate for their indefinitely detained, still untried clients, most of whom will probably never leave that prison. Despite the executive order President Obama signed on his first day in office to close GITMO, it remains open to this day and Donald Trump has promised to “load it up with some bad dudes,” Geneva Conventions be damned.

Indeed, Secretary of Defense James (“Mad Dog”) Mattis has said that the president has the right to lock up anyone identified as a “combatant” in our forever wars, well, forever. In 2016, he assured the Senate Armed Services Committee that any detainee who “has signed up with this enemy” -- no matter where “the president, the commander-in-chief, sends us” to fight -- should know that he will be a “prisoner until the war is over.” In other words, since the war on terror will never end, anyone the U.S. captures in Afghanistan, Iraq, Niger, Somalia, Syria, Yemen, or elsewhere will face the possibility of spending the rest of his life in Guantánamo.

Recycling War Criminals

Speaking of Mattis and war crimes, there’s already plenty of blood on his hands. He earned that “Mad Dog” sobriquet while commanding the U.S. Marines who twice in 2004 laid siege to Fallujah. During those sieges, American forces sealed that Iraqi city off so no one could leave, attacked marked ambulances and aid workers, shot women, children, and an ambulance driver, killed almost 6,000 civilians outright, displaced 200,000 more, and destroyed 75% of the city with bombs and other munitions. The civilian toll was vastly disproportionate to any possible military objective -- itself the definition of a war crime.

One of the uglier aspects of that battle was the use of white phosphorus, an incendiary munition. Phosphorus ignites spontaneously when exposed to air. If bits of that substance attach to human beings, as long as there’s oxygen to combine with the phosphorus, skin and flesh burn away, sometimes right into the bone. Use of white phosphorus as an anti-personnel weapon is forbidden under the Chemical Weapons Convention, which the U.S. has signed.

In Iraq, Mattis also saw to it that charges would be dropped against soldiers responsible for murdering civilians in the city of Haditha. In a well-documented 2005 massacre -- a reprisal for a roadside bomb -- American soldiers shot 24 unarmed men, women, and children at close range. As the convening authority for the subsequent judicial hearing, Mattis dismissed the murder charges against all the soldiers accused of that atrocity.

Mattis is hardly the only slightly used war criminal in the Trump administration. As most people know, the president has just nominated Deputy CIA Director Gina Haspel to head the Agency. There are times when women might want to celebrate the shattering of a glass ceiling, but this shouldn’t be one of them. Haspel was responsible for running a CIA black site in Thailand, during a period in the Bush years when the Agency’s torture program was operating at full throttle. She was in charge, for instance, when the CIA tortured Abd al-Rahim al-Nashiri, who was waterboarded at least three times and, according to the executive summary of the Senate Intelligence Committee’s Torture report, “interrogated using the CIA's enhanced interrogation techniques.” (The report provided no further details.)

Haspel was also part of the chain of command that ordered the destruction of videotapes of the torture of Abu Zubaydah (waterboarded a staggering 83 times). According to the PBS show Frontline, she drafted the cable that CIA counterterrorism chief José Rodríguez sent out to make sure those tapes disappeared. In many countries, covering up war crimes would itself merit prosecution; in Washington, it earns a promotion.

More on Trump and Torture

Many people remember that Trump campaigned on a promise to bring back waterboarding “and a whole lot worse.” On the campaign trail, he repeatedly insisted that torture “works” and that even “if it doesn’t work, they [whoever “they” may be] deserve it anyway, for what they’re doing.” Trump repeated his confidence in the efficacy of torture a few days after his inauguration, saying that “people at the highest level of intelligence” had assured him it worked.

Trump’s nominee to replace Rex Tillerson as secretary of state is former Tea Party congressman and CIA Director Mike Pompeo. Known for his antipathy to Muslims (and to Iran), he once endorsed calling his Indian-American electoral opponent a “turban topper.”

Pompeo is as eager as Trump to restore torture’s good name and legality, although his public pronouncements have sometimes been more circumspect than the president’s. During his CIA confirmation hearings he assured the Senate Intelligence Committee of what most of its members wanted to hear: that he would “absolutely not” reinstitute waterboarding and other forms of torture, even if ordered to do so by the president. However, his written testimony was significantly more equivocal. As the British Independent reported, Pompeo wrote that he would back reviewing the ban on waterboarding if prohibiting the technique was shown to impede the “gathering of vital intelligence.”

Pompeo added that he planned to reopen the question of whether interrogation techniques should be limited to those -- none of them considered torture techniques -- found in the Army Field Manual, something legally required ever since, in 2009, President Obama issued an executive order to that effect. (“If confirmed,” wrote Pompeo, “I will consult with experts at the [Central Intelligence] Agency and at other organizations in the U.S. government on whether the Army Field Manual uniform application is an impediment to gathering vital intelligence to protect the country.”) Unlike many of Trump’s appointees, Pompeo is a smart guy, which makes him all the more dangerous.

When President Trump lists his triumphs, often the first one he mentions is the confirmation of Neil Gorsuch as a Supreme Court justice. Gorsuch, too, played a small but juicy role in the Bush torture drama, drafting the president’s signing statement for the Detainee Treatment Act when he worked in the Justice Department’s Office of Legal Counsel back in 2005. That statement officially outlawed any torture of “war on terror” detainees, and yet left open the actual practice of torture because, as Gorsuch assured President Bush, none of the administration’s self-proclaimed “enhanced interrogation techniques” (including waterboarding) amounted to torture in the first place.

Still, of all Trump’s recycled appointments, the most dangerous of all took place only recently. The president fired his national security advisor, Lieutenant General H.R. McMaster, and replaced him with John Bolton of Iran-Contra and Iraq invasion fame.

Under George W. Bush, Bolton was a key proponent of that invasion, which he’d been advocating since at least 1998 when he signed an infamous letter to Bill Clinton from the Project for a New American Century recommending just such a course of action. In 2002, Bolton, while undersecretary of state for arms control, engineered the dismissal of José Bustani, the head of the U.N.’s Organization for the Prohibition of Chemical Weapons, which was involved in overseeing Iraq’s disarmament process. A former Bolton deputy told the New York Times that Bolton was dismayed because Bustani “was trying to send chemical-weapons inspectors to Baghdad in advance of the U.S.-led invasion.” Presumably Bolton didn’t want the U.N. trumpeting the bad news that Iraq had no active chemical weapons program at that moment.

Nor has Bolton ever forgotten his first Middle Eastern fascination, Iran, although nowadays he wants to attack it (along with North Korea) rather than conspire with it, as President Reagan and he did in the 1980s. He’s argued in several editorials and as a Fox News commentator -- wrongly as it happens -- that it would be completely legal for the United States to launch first strikes against both countries. Naturally, he opposes the six-nation pact with Iran to end its nuclear weapons program. When that agreement was signed, the New York Times ran an op-ed by Bolton entitled “To Stop Iran’s Bomb, Bomb Iran.” It should (but doesn’t) go without saying that any first strike against another country is again the very definition of the initial crime on that Nuremberg list. 

Recycling War Crimes

We can’t blame the Trump administration for the decision to support Saudi Arabia’s grim war in Yemen, a catastrophe for the civilians of that poverty-stricken, now famine-plagued country. That choice was made under Barack Obama. But President Trump hasn’t shown the slightest urge to end the American role in it either. Not after the Saudis threw him that fabulous party in Riyadh, projecting a five-story-high portrait of him on the exterior of the Ritz Carlton there. Not after his warm embrace of Saudi crown prince Mohammed bin Salman during his recent visit to the United States. In fact, at their joint press conference, Trump actually criticized former president Obama for bothering the Saudis with complaints about human rights violations in Yemen and in Saudi Arabia itself. 

Meanwhile, the United States continues to fund and support the Saudi military’s three-year-old war crime in that country, providing weaponry (including cluster bombs), targeting intelligence, and mid-air refueling for Saudi aircraft conducting missions there. The conflict, which the New York Times has called “the world’s worst humanitarian crisis,” has killed at least ten thousand people, although accurate numbers are almost impossible to come by. As of December 2017, the Yemen Data Project had catalogued 15,489 separate air attacks, of which almost a third involved no known military targets and another 4,800 hit targets that have yet to be identified. Hospitals and other health facilities have been targeted along with crowded markets. Government funding for public health and sanitation ended in 2016, leading to a cholera epidemic that the Guardian calls “the largest and fastest-spreading outbreak of the disease in modern history.” 

Through the illegal blockading of Yemen's ports, Saudi Arabia and its allies have exposed vast numbers of Yemenis to the risk of famine as well. Even before the latest blockade began in November 2017, that country faced the largest food emergency in the world. Now, it is in the early stages of a potentially devastating famine caused entirely by Saudi Arabia’s illegal war, aided and abetted by the United States. In addition, Trump has increased the number of drone assassinations in Yemen, with their ever-present risk of civilian deaths.

Yemen is hardly the only site for actual and potential Trump administration war crimes. In response to requests from his military commanders, the president has, for instance, eased the targeting restrictions that had previously been in place for drone strikes, a decision he’s also failed to report to Congress, as required by law. According to Al-Jazeera, such drone strikes in countries ranging from Libya to Afghanistan will no longer require the presence of an “imminent threat,” which means “the U.S. may now select targets outside of armed conflict,” with increased risk of hitting noncombatants. Also relaxed has been the standard previously in place “of requiring ‘near certainty’ that the target is present” before ordering a strike. Drone operators will now be permitted to attack civilian homes and vehicles, even if they can’t confirm that the human being they are searching for is there. Under Trump, the CIA, which President Obama had largely removed from the drone wars, is once again ordering such attacks along with the military. All of these changes make it more likely that Washington’s serial aerial assassinations will kill significant numbers of civilians in Iraq, Syria, Yemen, and other target countries.

Defense Secretary Mattis has also loosened the rules of engagement in Afghanistan by, for example, removing the “proximity requirement” for bombing raids. In other words, U.S. forces are now free to drop bombs even when the target is nowhere near U.S. or Afghan military forces. As Mattis told the Senate Armed Services Committee last October,

“If they are in an assembly area, a training camp, we know they are an enemy and they are going to threaten the Afghan government or our people, [Gen. John Nicholson, commander of U.S. Forces Afghanistan,] has the wherewithal to make that decision. Wherever we find them, anyone who is trying to throw the NATO plan off, trying to attack the Afghan government, then we can go after them.”

Under such widened rules for air strikes -- permitting them anytime our forces notice a group of people “assembling” in an area -- the chances of killing civilians go way up. And indeed, civilian casualties rose precipitously in Afghanistan last year.

And then there’s always the chance -- the odds have distinctly risen since the appointments of two raging Iranophobes, Pompeo and Bolton, to key national security positions -- that Trump will start his very own unprovoked war of aggression. “I’m good at war,” Trump told an Iowa rally in 2015. “I’ve had a lot of wars of my own. I’m really good at war. I love war in a certain way, but only when we win.” With Mike Pompeo whispering in one ear and John Bolton in the other, it's frighteningly likely Trump will soon commit his very own war crime by starting an aggressive war against Iran.

mong the most disturbing accusations the pornographic film star Stephanie Clifford made in her “60 Minutes” interview about President Trump was that after she sold her story about Mr. Trump to a magazine in 2011, a man approached her in a parking lot, while she was with her infant daughter, and said: “Leave Trump alone. Forget the story.”

“And then he leaned around,” she continued, “and looked at my daughter and said: ‘That’s a beautiful little girl. It’d be a shame if something happened to her mom.’ ”

Five years later, said Ms. Clifford, known professionally as Stormy Daniels, when Mr. Trump’s lawyer Michael Cohen offered to pay her $130,000 to be silent about her relationship with Mr. Trump, she took the deal because she “was concerned for my family and their safety.”

Republicans Now Want to Balance the Federal Budget After Passing $1 Trillion Tax Cut

ongressional Republicans are planning to push a balanced budget amendment when they return from recess in April, Politico reported on Wednesday. The vote comes directly after many of those same Republicans voted to pass two massively expensive measures, a $1.3 trillion dollar spending bill and a $1 trillion dollar tax cut that primarily benefits the wealthiest Americans.

The attempt at a balanced budget amendment is mostly a shiny gimmick meant to gin up support for Republicans as they approach the 2018 midterm elections. The tax bill is largely unpopular with Americans and very few have actually seen any change in their paychecks, contrary to what President Donald Trump and other Republicans promised.

“It’s almost election season, and it would be helpful if GOP lawmakers could go home and be able to say they voted to support balancing the federal budget, even though they voted boosted discretionary spending by a ton, and have not touched entitlement spending, which, they have said for years, is the driver of U.S. budget deficits,” Politico’s Jake Sherman, Anna Palmer, and Daniel Lippman wrote.

Also in the works is a plan for a second round of tax legislation to make tax cuts for individuals permanent. Republicans came under fire during negotiations for providing corporations with a permanent tax cut while individuals and families only received temporary ones, and making individual cuts permanent might help stem the backlash in the lead up to midterms.

House Ways and Means Chairman Kevin Brady confirmed the existence of such legislation earlier in March, after President Trump stated three times in the month of February that Brady was working on a second tax bill.

“We think even more can be done,” Brady said during a Fox Business appearance on March 14. “While the tax cuts for families were long-term, they’re not yet permanent. So we’re going to address issues like that. We’re in discussions with the White House, the president, on this issue.”

Making the individual cuts permanent will cost an estimated $1.5 trillion in the decade after 2025, according to a Tax Foundation analysis using numbers from the Joint Committee on Taxation.

As Politico previously reported, Republicans are attempting to use the second round of tax cuts as a way to shame Democrats who fail to support what the GOP sees as their biggest legislative accomplishment during the Trump administration.

Adam Jentleson, who served as deputy chief of staff for the former Democratic Senate Majority Leader Harry Reid, told Bloomberg there’s “very little chance” that the nine Democrats needed to pass the tax cuts would back a bill centered on making the individual tax changes permanent.

“It is a cheap political exercise and they shouldn’t lend it any more credence than it deserves,” he said.

Legislation like the balanced budget amendment, which forces Washington to be more fiscally responsible, sounds good in theory, but the reality is that, to achieve that goal, cuts will have to made and taxes will likely have to be raised. With a Republican-controlled Congress and a House speaker who has dreamed of slashing entitlement programs since taking office, that most likely means devastating cuts to welfare, Medicaid, Medicare, and Social Security, at the very least.

That Republicans have their eye on slashing government programs comes as no surprise, of course. Shortly after Congress passed the tax bill, The New York Times warned of the “Trojan horse” hidden in the legislation that will serve as the setup for steep cuts. Paul Ryan himself said outright that Medicare and Medicaid were his next targets for 2018.

“We’re going to have to get back next year at entitlement reform, which is how you tackle the debt and the deficit,” Ryan said during an appearance on Ross Kaminsky’s talk radio show. “… Frankly, it’s the health care entitlements that are the big drivers of our debt, so we spend more time on the health care entitlements — because that’s really where the problem lies, fiscally speaking.”

Will a Hard-Hitting Investigation Into Israel's Influence in US Government Ever See the Light of Day?

o when am I going to be able to watch Al Jazeera’s hard-hitting investigation into Israel’s powerful lobby in the United States? Remember Al Jazeera? The tough, no-holds-barred Middle East satellite channel that transformed Qatar into a media empire whose reports frightened dictators and infuriated potentates and presidents alike? Why, George W Bush once wanted to bomb its headquarters in Doha – so it must have been doing something right. It even has an office in Jerusalem.

But something seems to be amiss. Not Al Jazeera’s disastrous American venture, which was supposed to break free of the dross on CNN and Fox News and ended up looking just like CNN or Fox. Nor the tragicomedy of its journalists’ imprisonment in Sissi’s Egypt, banged up by Cairo’s farcical laws and the stupidity of Al Jazeera’s own management in Qatar.

No, I’m talking about a documentary called The Lobby, directed by one of Al Jazeera’s top journalists, Clayton Swisher, the man whose exclusive (and book) on the “Palestine Papers” blew open the secret and scandalous American-led negotiations between Israelis and the Palestinian authority between 2000 and 2010. But after months of postponement, The Lobby, which secretly filmed pro-Israeli US activists and Israeli government officials and was completed last autumn, is still no nearer to being shown – and Swisher himself has taken a paid leave of absence. He even chose to explain his frustration in an article for the progressive American Jewish magazine Forward, which has always maintained a liberal and often very critical view of Israel.

“Don’t mistake me – I love Al Jazeera,” Swisher told me this week. “I love working for Al Jazeera. They’ve done fantastic things. And they look after their staff very well. But our new documentary doesn’t seem to be getting on air.”

In his published explanation, Swisher described how his award-winning investigative unit – which he says operates “without [Qatari] government interference” – sent an undercover reporter to look into “how Israel wields influence in America through the pro-Israeli American community. But when some right-wing American supporters of Israel found out about the documentary, there was a massive backlash. It was even labelled as antisemitic in a spate of articles.”

Nothing surprising there, you might think. Any reporters who have dared to criticise Israel grow used to the vile smear of antisemitism thrown over them – but there was an even more disturbing background to Swisher’s attempts to get his documentary on the air.

The programme’s completion, he writes, “came at a time when, due to an arbitrary blockade on Qatar imposed by the United Arab Emirates and Saudi Arabia, Qatar had been pursuing an end to its siege by appealing to the US. According to reports, Qatar sought to offer its own side of the narrative in this conflict by hosting thought leaders, including from the American Jewish community. From reports in the Israeli press, I learned that [Harvard Professor Alan] Dershowitz had been brought to meet with the Qatari emir [Tamim bin Hamad Al Thani], and that the American Jews had brought up what they saw as Al Jazeera’s antisemitism in those meetings. Of course, our documentary is not antisemitic. It is an exploration of how Israel, a foreign government, influences US foreign policy.”

Ironically, one of the Saudi-UAE demands for a return to normal relations with Qatar was to shut down Al Jazeera.

Most of Swisher’s staff within Al Jazeera are American or British, and he recruited a young Oxford postgraduate, James Anthony Kleinfeld, to meet and mix with members of pro-Israeli groups in Washington. When this was discovered – partly because Swisher, for legal reasons, contacted those appearing in the programme to say that his team had used secret filming during their investigations – there was uproar.

Kleinfeld, who apparently used the name “Tony Kleinfeld”, was accused of being “pro-Palestinian” but of “embedding himself with the Washington pro-Israel crowd” while spending “months of his life under a new and meticulously fabricated persona to infiltrate pro-Israeli groups”.

The concern of Israeli lobbyists was not without reason. Recipients of legal letters from the documentary group – referring to the secretly recorded Israeli activists – included AIPAC, the Israeli-American Council, the Sheldon Adelson-created Maccabee Task Force, the Israel Project, the Zionist Organisation of America and other groups. Although Swisher’s reporters had exposed genocide in Myanmar, presidential corruption in the Maldives and paedophilia in British youth football, another documentary under Swisher’s direction concentrated on Israel’s influence over Britain and included a secretly filmed sequence in which Israeli official Shai Masot discussed how to “take down” British MPs regarded as pro-Palestinian, including Sir Alan Duncan. Masot was forced to resign and the Israeli ambassador to London, Mark Regev, issued a formal apology.

According to Swisher, if his documentary on the American lobby doesn’t air soon, “it might prove to be ammunition sought by a group of zealous US politicians who wish to declare Al Jazeera a foreign entity, and label us journalists as ‘spies’”. In response to antisemitism claims after the London documentary, the broadcasting regulator Ofcom ruled that the programme was “a serious investigative documentary”. It was the same question, Swisher says, that he and his team sought to answer in the American edition of The Lobby: “whether the Israeli government was funding or involved in lobbying efforts in the US under the guise of a domestic lobbying group”.

Swisher says that several “leaders of Jewish American organisations” met with Qatar’s registered agent and lobbyist, Nick Muzin – a former aide to US Senator Ted Cruz, who supported American recognition of Jerusalem as Israel’s capital – “to see if he could use his ties with the Qataris to stop the airing”. Since October, Swisher says, “we’ve faced a series of unexplained delays on broadcasting our project, the likes of which I’ve never experienced. I was repeatedly told by everyone to ‘wait’, and was assured our documentary would eventually see the light of day. Then, as now, I took my senior management at its word. To my own specially trained ears, ‘wait’ did not constitute ‘stop’. In fact, it must not constitute ‘stop’.”

Almost every journalist I’ve met in the Middle East has encountered similar problems. When I worked for the The Times, I alerted the then editor, Charles Douglas-Home, to evidence that Israeli officers had secretly buried at least seven Palestinian and Lebanese prisoners – done to death in an interrogation centre – at night in a Sidon graveyard in 1983. He wanted me to spend as many weeks as necessary to find out if the story was true. Then, months later, when witnesses emerged with evidence of the burial, including the gravedigger – the bodies still had their hands tied behind their back with nylon rope when they were brought to him – I called my editor. My witnesses were being “visited” by armed members of the Israeli Shin Beth intelligence agency, I told him, and I was being trailed around Sidon by Israeli-registered vehicles. It was time to run the story.

To my shock, Douglas-Home – an editor who otherwise loyally stood by me in every Middle East dispute over my work – replied that he wasn’t sure “how we’re justified in running a story like this so long after the event”. In other words, we had to be sure of our facts on such an important story – but by taking the time to do just that, the story was now out of date.

After much argument – during which I suggested to the Israelis that they might like to institute a military inquiry into the deaths if they wanted to avoid a scandal (they said, mysteriously, that it was already under way, although I doubted this) – the story ran. A deputy editor, I was told, had tried to cut the report by two-thirds. He was overruled. Then the story ran. In full.

So, old story, new story. I’ve appeared many times on Al Jazeera. And never been told to mince my words. Nor would I. But a lot of us are waiting to see Swisher’s new documentary. If we don’t, we’ll know what to think of Al Jazeera.

How Scott Walker Dismantled Wisconsin's Environmental Legacy

As governor of Wisconsin, the likely Republican presidential nomination-seeker consistently dismissed science and sided with polluters

hen Wisconsin’s new state treasurer Matt Adamczyk took office in January, his first act was to order a highly symbolic change in stationery. Adamczyk, a Republican and one of three members of the board that oversees a small public lands agency, “felt passionately” that Tia Nelson, the agency’s executive secretary, should be struck from the letterhead. As soon became clear, his principal objection to Nelson, daughter of former Wisconsin governor and environmentalist-hero Gaylord Nelson, was that in 2007–08 she had co-chaired a state task force on climate change at the then-governor’s request. Adamczyk insisted that climate change is not germane to the agency’s task of managing timber assets, and that Nelson’s activities thus constituted “time theft.” When he couldn’t convince the two other members of the agency’s board to remove Nelson from the letterhead, he tried to get her fired. When that motion failed, he moved to silence her. In April the board voted 2–1 to ban agency staff from working on or discussing climate change while on the clock. The climate censorship at the public lands agency made national headlines.

Wisconsin Gov. Scott Walker has kept his distance from Adamczyk. It is easy to see why: Walker is widely expected to announce a bid for the Republican presidential nomination. And his environmental legacy—which so far has gone largely unexamined in the national press—has reached much farther than anything the board of a tiny public lands agency could accomplish.

Since taking office in 2011 Walker has moved to reduce the role of science in environmental policymaking and to silence discussion of controversial subjects, including climate change, by state employees. And he has presided over a series of controversial rollbacks in environmental protection, including relaxing laws governing iron mining and building on wetlands, in both cases to help specific companies avoid regulatory roadblocks. Among other policy changes, he has also loosened restrictions on phosphorus pollution in state waterways, tried to restrict wind energy development and proposed ending funding for a major renewable energy research program housed at the University of Wisconsin–Madison.

Most recently Walker has targeted the science and educational corps at the state’s Department of Natural Resources (DNR), which has responsibility for protecting and managing forests and wildlife, along with air and water quality. In his 2015–17 budget, released in February, he proposed eliminating a third of the DNR’s 58 scientist positions and 60 percent of its 18 environmental educator positions. (The cuts were approved by the state legislature’s budget committee in May, and the budget is currently making its way through the legislature.) Walker also attempted to convert the citizen board that sets policy for the DNR to a purely advisory body and proposed a 13-year freeze on the state’s popular land conservation fund—both changes that lawmakers rejected in the face of intense public objections.

Walker’s office did not respond to repeated requests for comments for this article. But he and his allies in the Republican-controlled legislature have said that such policy shifts will streamline regulations that they say interfere with business development. Many scientists and environmental advocates as well as some conservative political and business leaders say Walker’s actions diminish the role of science in policy decisions and undermine key environmental protections that have long distinguished Wisconsin as a conservation leader.

“I just see a guy who’s afraid of the mob”
One of the biggest environmental controversies to mark Walker’s tenure came in 2013, when he signed a law paving the way for Gogebic Taconite, a mining company later revealed to be a major political donor, to build a 6.5-kilometer-long open-pit mine in the Penokee Hills region in the Lake Superior watershed. Citing a 2011 study funded by Gogebic, Walker argued the mine would bring thousands of jobs to the struggling region. Gogebic helped write the new law, which allows companies to dump mine waste into nearby wetlands, streams and lakes; doubles the area around a mine that a company can pollute; allows the DNR to exempt any company from any part of the law; and strips citizens of the right to sue mining companies for illegal environmental damage.

The new law also included a philosophical shift: Where the old law specified that mining should impact wetlands as little as possible, the new one says that significant adverse impacts on wetlands are presumed to be necessary.

Gogebic dropped the Wisconsin mining project after finding more wetlands than expected in the area, raising questions about the cost of meeting federal mitigation standards. The rewritten Wisconsin law, however, would govern any future projects.

Phosphorus pollution has been another flashpoint. In 2010 Wisconsin was the first state in the U.S. to adopt rules imposing numeric limits on phosphorus pollution, which impairs hundreds of Wisconsin waterways and can harm aquatic life and human health. When Walker took office in 2011, he argued that the rules would be too expensive for manufacturers and communities to follow and proposed to delay implementing them for two years. In 2014 he signed a law allowing polluters to postpone meeting the phosphorus restrictions if they could demonstrate that complying with the rules would pose a financial hardship. Environmental groups say that by diminishing polluters’ responsibility for reducing phosphorus discharges, the law is a step backward for water quality.

Walker has also resisted measures to reduce carbon emissions that contribute to climate change. Like many Republican governors and lawmakers, he has avoided making public remarks on climate change. But his actions paint a picture.

In 2008 before he was governor, he signed the Koch-backed “No Climate Tax Pledge,” vowing to oppose any climate legislation that increased government revenue. In 2014 he appointed a utility commissioner who said in a confirmation hearing that “the elimination of essentially every automobile would be offset by one volcano exploding,” a remark he later recanted. In February a child asked Walker what he would do about climate change if he were president. Walker’s reply: as a Boy Scout he believed in leaving his campsite cleaner than when he found it. Nevertheless, this spring Wisconsin joined 13 other states in a lawsuit challenging U.S. Environmental Protection Agency’s proposed Clean Power Plan, which would cut carbon emissions from Wisconsin power plants by 34 percent by 2030. (A federal court dismissed the suit on June 9.)

Walker has argued, based on a study funded by the coal company Peabody Energy, that the new rules are “unworkable” because they would be too expensive for manufacturers and residents and has implied that Wisconsin might not comply with them.

Although some conservatives in Wisconsin praise Walker’s actions, he’s attracted the ire of others, including former Republican state senator Dale Schultz, who retired from the senate last winter after 32 years in the legislature. “I think what’s going on is appalling,” Schultz says. “As somebody who thinks that should be the first thing conservatives ought to be doing is protecting our environment, it’s embarrassing. I’m a pretty pro-business Republican. But a clean environment is essential to business. This is just wholly unacceptable.”

Schultz attributes Walker and other far-right Republicans’ policy positions to the demands of wealthy benefactors, especially those connected to the energy industry. “Some days I look at Governor Walker and I just see a guy who’s afraid of the mob,” Schultz says. “He helped create it, he fosters it, but then he’s also fearful of it.”

“The term ‘climate change’ has become a red flag”
The Walker administration’s policy changes have been accompanied by efforts to weaken scientists’ role in policymaking. Even before taking office, Walker signaled his environmental agenda by appointing former Republican state senator and construction-company owner Cathy Stepp as DNR secretary, explaining that he wanted “someone with a chamber-of-commerce mentality” at the agency’s helm. Stepp, who does not have a background in science or natural resource management, had publicly derided DNR staff as “unelected bureaucrats who have only their cubicle walls to bounce ideas off of” and who thus “tend to come up with some pretty outrageous stuff that those of us in the real world have to contend with.”

Recently retired scientists spoke to a sharp shift under Stepp’s leadership. Adrian Wydeven, a wolf biologist who ran the DNR’s wolf management program from 1990 until 2013 and retired last year, points to the 2013 restructuring of all the DNR’s wildlife advisory committees. In that restructuring the agency removed university scientists and greatly reduced the number of DNR professional staff; it also gave special interest groups, such as politically influential pro-hunting groups, more slots. Wydeven says the DNR has also restricted scientists’ opportunities to speak directly with lawmakers about proposed regulations and has become deferential toward the legislature. “In the past, if the legislators were proposing anything that wasn’t scientifically sound, the DNR was much more forceful in disagreeing with the legislature and making recommendations to improve the legislation,” he says. “Now there’s much less of that.”

Although DNR researchers haven’t been explicitly forbidden from mentioning climate change (as Tia Nelson was at the public lands agency until the board yesterday amended its policy to ban staff only from engaging in advocacy on climate policy), they nonetheless describe a “chilling effect” on discussion about politically controversial subjects. In November 2010 the DNR's main climate change Web page was a rich portal containing detailed information about climate trends, forecasted impacts of climate change and DNR programs aimed at addressing the problem. The page also acknowledged that "the most renowned group of scientists working on climate change, the Intergovernmental Panel on Climate Change (IPCC), stated that it is very likely [more than 90 percent probability] that human activity is responsible for rising temperatures." Today, the page contains a single paragraph describing, in general terms, a partnership with the University of Wisconsin to study the impacts of climate change and a link to the university’s project Web site.

The chilling effect is also evident in internal discussions, DNR scientists say. Sally Kefer, a land use expert who retired from the DNR in 2014, says that she encountered increasing institutional resistance to discussing climate change in the course of helping communities prepare for a warmer and wetter future. “I was being told to quit contacting the communities to determine their level of interest in having a discussion about climate adaptation,” Kefer says. “I was told to wait until they called me. And can’t I figure out a way to call it something other than ‘climate adaptation’? Can’t we just call it ‘sustainability’?” A current DNR scientist, who requested anonymity, says that the term “climate change” has become a red flag in internal grant proposals. “It’s impossible to work on natural resources without incorporating climate change in some way,” the researcher says. But “we’re less likely to cause problems if we just call it something else. ‘Environmental variability’is sort of our code word.”

Kimberlee Wright, executive director of Midwest Environmental Advocates, an environmental law center, works closely with DNR engineers and scientists to review and comment on pollution permits for activities such as wastewater disposal and groundwater pumping under the Clean Water Act. In the past, Wright says, the process was typically straightforward, and she and colleagues were routinely able to hammer out permits that followed the technical requirements of the law. But since Gov. Walker took office, she says, “We have not been able to settle one permit—we’ve had to litigate every single challenge. We’re often told by [DNR] staff, ‘We know you’re right, but you’re going to have to sue us because the people above me won’t let me issue a technically sufficient permit.’ That’s a really big difference—the interference in science-based decision-making is pretty complete.”

The DNR Office of Communications did not permit agency scientists to be interviewed for this article and did not make Sec. Stepp or Bureau of Science Services Director Jack Sullivan available for comment on whether the agency restricts scientists’ freedom to communicate about areas of their expertise. The department’s spokesperson, William Cosh, said in an e-mail that “When it comes to making decisions the agency remains committed to doing so by using sound science, following the law and using common sense.”

But Walker’s 2015–17 budget proposal, which called for eliminating a third of all research scientist positions and more than half of environmental educator positions from the DNR, would dramatically decrease the influence of science on natural resources policy and public outreach.

According to the state’s bipartisan Legislative Fiscal Bureau, which provides fiscal information to the lawmakers, about half of the scientist positions Walker slated for elimination are federally funded. In March Stepp said the agency was considering subsuming remaining positions into other parts of the agency, dissolving the Bureau of Science Services altogether. Walker has indicated that he wants science to inform policy decisions on “an as-needed basis.” The agency spokesperson said the cuts do not eliminate the agency’s research capacity. “What these cuts require us to do,” he said in an e-mail, “is to better prioritize the research that our scientists are engaged in to help inform management decisions.”

DNR scientists reject that assertion. “I don’t understand how they can say with a straight face that cutting a third of the research program will not diminish their capacity to do research,” says one researcher, who requested anonymity. “We already have a pretty formalized process of prioritizing research; every two years we go through a process where they identify their research needs.”

Walker’s proposal to shrink the DNR’s scientific capacity appears to have been the brainchild of Tom Tiffany, a GOP state senator who is a longtime critic of the DNR’s science bureau. In May he confirmed on a regional radio program that he requested Gov. Walker cut the DNR scientist, educator and communications positions. Tiffany said he thinks the agency’s scientists have a wildlife management “agenda” that has driven the agency to mismanage the deer herd, curtailing sportsmen’s hunting opportunities. He has also said he believes the agency’s scientists spend too much time on controversial subjects like climate change, which he views as “theoretical.” (According to DNR records, just under 3 percent of DNR scientists’ work hours during the last fiscal year involved activities related to climate change.)

The DNR changes are “an assault on the science side of policy making,” says Curt Meine, a conservation biologist and biographer of conservation pioneer Aldo Leopold. “Wisconsin’s conservation has always been built on a broad public commitment to building and sustaining the health of the landscape and the inherent connection between a healthy economy and healthy land and waters,” he says. “We have a long record of bipartisan support for that. There’s always been tensions, there always will be tensions, maybe—but science has always been a way of talking across those divisions because everybody wants good information to make decisions. Now that legacy, fostered by the likes of Aldo Leopold and Gaylord Nelson, is eroding away.”
