El Salvador: Jailed Rape Survivor Who Gave Birth to Stillborn Baby, Freed

The Salvadoran woman, sentenced to 30 years in prison for giving birth to a stillborn baby after having been raped, has been freed after 33 months.

velyn Beatriz Hernandez, 20, was freed Friday after serving 33 months in prison for giving birth to a stillborn child resulting from rape. She was charged by a Salvadoran court with “aggravated homicide” and sentenced to 30 years in prison.

After an appeal, the court said that she will be re-tried but will be able to live at home during the process.

Her imprisonment caused a storm among activists in the country, who greeted her release with chants like, "Evelyn, you are not alone."

"We are very happy because Evelyn is free and shares with her family the joy of returning home," said her lawyer Angelica Rivas.

Hernandez said in July 2017 that she did not know she was pregnant when she suffered a third-trimester stillbirth in a bathroom in April 2016.

She was allegedly raped by a gang member repeatedly over several months before going into labor. She was too afraid to report the rapes.

Medical experts were unable to ascertain whether the fetus died in utero or in the moments after delivery, but the female judge accepted the prosecutor’s claims that Hernandez failed to seek prenatal care during pregnancy, which was tantamount to murder under Salvadoran law.

El Salvador’s abortion law was implemented in 1998 after a campaign by a small group of powerful anti-abortion groups linked to the Catholic church.

Under the legislation, abortion is illegal under any circumstances, even in cases of rape, when a fetus has been injured or when the mother’s life is in danger.

According to the Citizens’ Group for the Decriminalization of Abortion, 129 women were convicted of abortion-related crimes between 2000 and 2011 in El Salvador.

Since 2015, 26 women have faced charges of murder.

A note of caution regarding our comment sections:

For months a stream of media reports have warned of coordinated propaganda efforts targeting political websites based in the U.S., particularly in the run-up to the 2016 presidential election.

We too were alarmed at the patterns we were, and still are, seeing. It is clear that the provocateurs are far more savvy, disciplined, and purposeful than anything we have ever experienced before.

It is also clear that we still have elements of the same activity in our article discussion forums at this time.

We have hosted and encouraged reader expression since the turn of the century. The comments of our readers are the most vibrant, best-used interactive feature at Reader Supported News. Accordingly, we are strongly resistant to interrupting those services.

It is, however, important to note that in all likelihood hardened operatives are attempting to shape the dialog our community seeks to engage in.

Adapt and overcome.

When will we of the 21st Century Left wake up and stop denying the ugly truth our Communist forebears knew too well, especially in the Soviet Union; that the Abrahamic religions -- Judaism, Christianity, Islam -- are based not on love but on relentless misogyny -- specifically the scripturally proclaimed hatred of Mother Earth and in fact of all femaleness.

Our forebears also knew these religions and their sadistic god as the most viciously counter-revolut ionary force on this planet -- worse even than the Nazism and fascism so gleefully embraced by Pius XII. Thus they believed it must be neutralized accordingly, lest women everywhere be as oppressed as they are in El Salvador or Saudi Arabia or Louisiana or the Hasidic cults in Brooklyn and Israel.

Given the serial atrocities of 6,000 years of patriarchy, it is no wonder nearly all progressive revolutions are started by women.

The judiciary in El Salvador should stand trial for femicide.

This crap in El Salvador reminds me strongly of why I strongly adhere to separation of church and state.

If trump is removed from office, pence must also be removed. pence is a crazed religionist who says that he hears a voice in his head that tells him what to say and do. He thinks the voice belongs to 'god.' Mental illness is a more likely explanation.

When legal abortions are banned, women in need resort to inept 'doctors' or try to perform a procedure themselves. This often causes not only the women's death (which the catholic church doesn't give a damn about) but ALSO the death of the 'all-important, all-sacred' fetuses. So these misogynistic anti-abortion religionists are evil hypocrites who are killing fetuses as well as women. I.e., they are anti-life.

Known perjurer kavanaugh was the only justice to write a dissent regarding the Louisiana abortion law, and no one else signed it. In it, he lied by omitting crucial facts, thus giving a false picture of the number of available clinics and qualified physicians and of women's ability to obtain an abortion. Now kavanaugh's lies are part of SCOTUS records and can be referenced by the next gods-damned fascist who may be appointed. Dishonest kavanaugh excels at this 'slippery slope' type of law-changing. He and gorsuch must also be removed from office.
