Supreme Court Halts Landmark Youth Climate Change Lawsuit

Chief Justice John Roberts gives the Trump administration another win.

.S. Supreme Court Chief Justice John Roberts brought a temporary halt late Friday to a landmark climate change lawsuit that was set to begin later this month.

President Donald Trump’s Justice Department asked the Supreme Court to stop the lawsuit in a filing on Thursday. Roberts approved the request on Friday even though the US high court in a unanimous ruling in July had said that the case could proceed.

Twenty-one children and young adults sued the federal government in August 2015, alleging the government had failed to protect them from the impacts of climate change.

ThinkProgress’ Kyla Mandel explained the basis for the case.

The lawsuit uses a legal theory known as atmospheric trust litigation, which argues the government must hold certain common elements such as rivers or shorelines, and in this case, the atmosphere, for public use. By failing to protect and preserve a clean atmosphere for future generations — by promoting fossil fuels, for instance — the lawsuit argues that the government is violating its obligation to the public trust.

Now, Roberts has halted discovery and the trial “pending a response to DOJ’s stay request, which is due by 3p Wednesday,” per BuzzFeed News’ Chris Geidner, who noted the timeline for the lawsuit is now unclear.

Trump, who once bizarrely claimed “global warming was created by and for the Chinese in order to make U.S. manufacturing non-competitive,” accused scientists of having a “political agenda” while discussing climate change during an interview on CBS’ 60 Minutes that aired last weekend.

His administration has mostly ignored a recent UN report that warned dangerous thresholds of climate change would be reached by 2040 at the current levels. Trump has largely surrounded himself with climate science deniers.

Proposed: The world's atmosphere, oceans, and weather are common to all nations and all people. No single nation, company, or individual has any inherent right to endanger the world environment, and international judicial entities must possess final jurisdiction over such threats, the provincial rulings of individual mations notwithstanding . Unlimited national sovereignty must stop where human survival is concerned.

The president is an idiot and anyone with an IQ of more than room temperature should understand that and not take seriously one word he utters. His base consists of illiterate morons some of whom have decided to corrupt Christianity for their own excuse for bad, juvenile behavior. They wouldn't know one of Christ's teachings from a brick wall. It's very important that trump keep these ignorant fools front and center to protect his image of popularity but they certainly are only a small percentage of the population in the overall. However, if the rest of us doesn't get out and vote, that small group will win.

My question is, since Congress hasn't passed any Exception or Regulations regarding this case, how can SCOTUS interfere with this lawsuit since the case is one where SCOTUS has only appellate jurisdiction?

According to the Constitution, Art III, Sec 2, "In all Cases affecting Ambassadors, other public Ministers and Consuls, and those in which a State shall be Party, the supreme Court shall have original Jurisdiction. In all the other Cases before mentioned, the supreme Court shall have appellate Jurisdiction, both as to Law and Fact, with such Exceptions, and under such Regulations as the Congress shall make."

This SCOTUS doesn't care about the constitution. There is no one to force them to care. They are the final authority.

And, the Lord put the planet in the hands of these fake Christians? At first I thought Trump supporters were gullible cult followers, now I see them as his storm troopers and colluders. As James L Christensen wisely said: "The purpose of Christianity is not to avoid difficulty, but to produce a character adequate to meet it when it comes. It does not make life easy; rather it tries to make us great enough for life." The White Messiah, Trump, is failing miserably at making this world a better place for all of humanity.
