Calls for Prosser Resignation More Than 10,000 Strong

By One Wisconsin Now

02 July 11

The people of Wisconsin have decided it's time for Prosser to go.

ore than 10,000 concerned citizens have signed One Wisconsin Now's petition launched Monday calling for the resignation of Wisconsin Supreme Court Justice David Prosser. One Wisconsin Now started the petition after Justice Ann Walsh Bradley said Prosser put her in a "chokehold" during an argument over Prosser's effort to muscle through a court decision in favor of GOP Sen. Scott Fitzgerald, who endorsed Prosser's 2011 re-election campaign.

"The people of Wisconsin have sent a unified and unmistakable message: 'David Prosser has got to go,'" said Scot Ross, One Wisconsin Now Executive Director. "The people have rejected Prosser's abusive behavior and feel he can no longer represent them on the Wisconsin Supreme Court."

Prosser's temper and caustic demeanor towards his colleagues has been well documented for nearly two decades. In the spring, One Wisconsin Now made public footage of Prosser charging at a colleague on the Assembly floor in the mid-1990s. Prosser was denounced in March for calling Chief Justice Shirley Abrahamson a "bitch" and threatening to "destroy" her.

Currently, the Dane County Sheriff's office and the Wisconsin Judicial Commission are investigating Prosser. This Wisconsin Judicial Commission investigation is only the third one against a sitting justice; all three investigations have occurred over the last five years.

The Supreme Court may ultimately be the body making the decision as to punishment in this investigation. All findings of the Wisconsin Judicial Commission will be passed on to the Supreme Court for them to decide whether to call for Prosser's suspension or removal. Prosser was previously the deciding vote to prevent fellow pro-corporate, conservative Justice Mike Gableman from being held accountable for a false ad against his opponent that was cited as the most racist television ad in the history of Wisconsin politics.

"If David Prosser's attack had happened in the private sector, he would have been fired on the spot," said Ross. "Wisconsin can't function with a partisan time-bomb like Prosser ticking on the court, intimidating and assaulting the other Justices, and demeaning the Supreme Court."

A copy of the petition including the video of Justice Prosser can be found here.

We are concerned about a recent drift towards vitriol in the RSN Reader comments section. There is a fine line between moderation and censorship. No one likes a harsh or confrontational forum atmosphere. At the same time everyone wants to be able to express themselves freely. We'll start by encouraging good judgment. If that doesn't work we'll have to ramp up the moderation.

General guidelines: Avoid personal attacks on other forum members; Avoid remarks that are ethnically derogatory; Do not advocate violence, or any illegal activity.

As much as I support the workers of Wisconsin and shared in the dismay of Prosser's questionable reelection, ...10,000 signatures is a good start but it hardly qualifies as sending a definitive statement of wisconsinite unanimity for his resignation. When it gets up to a 100,000 then I think a clear statement will have been made.

Give it time....they're just getting started.

I think Terre is correct. This thing is just getting started and 20 years is enough of this guy. It might even send a message to higher courts to behave like gentlemen and ladies.

Maybe Prosser has a career in professional wrestling. They look for new formats and male vs female might just be where he would excel. He could carry his gavel into the ring wearing his flowing robe and ergo, he would be called THE HAMMER SLINGER.

Maybe he should run for governor, it worked for a guy one state over.

People are beginning to wake up to these Republican right-wing bomb-throwers and its about time. They are mouthpieces for the corporate elites and their mission is to destroy the US government so that it no longer serves the needs of the American people. I think that Prosser kept his seat by illegal means, wasn't there a sudden discovery of thousands of pro-Prosser votes by an elections worker who had a shady past? Why wasn't this questioned after the election? The Republicans are very organized in their vicious attack on the common good, and Democrats can't seem to get their act together to stand up to them. We need to work in our local areas to turn back this right-wing onslaught and our efforts must be long-term, and grass-roots all the way.

As a great legal scholar, John Yoo, who holds forth here in the Bay Area at Boalt Hall, UC Berkeley (teaching young Americans the true meaning of American law) has amply and successfully argued, even what most would call overt torture is o.k. if it serves a sufficiently important goal. Until or unless Justice Prosser actually strangles Justice Ann Bradley, and she dies--and does so in the presence of creditable witnesses, it seems then a bit premature to go about sanctioning Prosser. I mean Prosser HAS this debt to Scott Fitzgerald, so there can be no doubting that he's putting choke-holds on Bradley for a worthy cause. (As that other great legal scholar, Richard Nixon, used to say: "Public life is no game for sissies!")

tomo: I know what you're saying. Look at what Bushco did, and they weren't impeached. Given that, I don't think strangling is an impeachable offense. Now if Prosser had water-boarded Bradley 183 times, we might be able to make a case, but given precedents, it is doubtful. Beginning with Reagan, we've strayed down a long, wrong road. Where will it end?

The problem is, who would replace him?

Governor Feingold (if he's just patient enough to wait a bit to get thrown out).

Now, wait: didn't Ann Walsh Bradley attack Prosser and he defended himself? Why the hodtility toward Prosser and nothing towards Bradley - is this ageism, sexism or simply political bias fueling these ill-considered opinions?

This sort of thing has come around before. Listen to this song by Malvina Reynolds when Wisconsin unelected Judge Simonson.

Rules for Radicals (Wisconsin liberals), ...run to Illinois instead of doing the job elected for, demand recounts, attempt to block legislation, create recalls, generate false accusations, spend tax payer money. Ulitmately, never admit defeat. This is NOT what Democracy looks like. however, there is a word for it...childish.
