Healthcare Victory, a Mandate to Act
29 June 12
ven though it's been a few hours now, I'm guessing you're still pinching yourself to make sure you're not dreaming. But yes, it happened. At 10:07 this morning, the conservative Chief Justice of the U.S. Supreme Court, John Roberts, not only joined with the liberal justices to completely uphold almost every single part of the Obama health care law, he wrote the majority opinion himself! In fact, he went even further. When he realized that the government had poorly made its constitutional case to the court, he went searching for a clause in their argument and the constitution that would give him the justification he needed to back the administration and to insure that his decision would hold up legally. In other words, even though he is on the opposite side of the political fence, he wrote the Dems' paper for them. Stunning.
The other four justices? They didn't just vote to overturn the individual mandate part of the law, they all voted to kill the entire Act.
The media is already spending much time talking about the mandate being the "centerpiece of the law," but the real news is that if you ever have a pre-existing condition, you cannot now be denied insurance. If you are a young adult without health insurance, you can now stay on your parents' plan until age 26. The insurance company can no longer say there is a lifetime cap to your coverage. The insurance companies are now required to spend 85 cents out of every dollar they take in on actual reimbursement for your health care – not on profit or "administrative costs" (some companies have been taking over a 30% cut; Medicare's total percentage of their budget for administrative costs: 2%).
I know that our side is not used to victories and so we're not quite sure how to respond when we get one out of the blue. For some of us, the first inclination is to point out just how weak the Obama law actually is, that it doesn't provide true universal health care (26 million will STILL be uninsured), and that it leaves control of the system in the hands of the vultures, otherwise known as the health insurance companies. The individual mandate was a huge gift to the private insurance companies, guaranteeing them billions more from millions of new customers. And many of the key provisions of this law don't even take effect until 2014 – and if the Republicans win in November, you can kiss all of that goodbye.
So, yes, the bill is highly flawed and somewhat wrong-headed – but what it IS is a huge step in the right direction. And today's court decision cements that. The right wing knows this and they are probably unraveling in some not-so-pretty ways right now. And that's why today is a great day. The Right has been smacked down by one of their own! They know what we all know — that the path of history has been, and will continue to move toward the basic human right that all people are entitled to see a doctor and NOT have to worry about losing their home because they can't afford to pay the medical bills. Those days are over, or will be soon, and that is where civilization is headed. It's not headed back to the days of Oliver Twist. Today's victory is momentum, it's forward motion, and we WILL have true universal health care in this country in the not too distant future.
So take some time tonight to celebrate; this is a victory for the people. Actually, more than a victory, it is a mandate that all of us must now make sure that a second-term Obama continues to move the ball down the field, toward a system like they have in every other First World country on the planet. He simply has to improve Medicare and then expand it to every citizen in the country. The countries that do this, their people live an average of two to four years longer than we do. Is there a reason anyone doesn't want an extra four years of their lives? Or that our babies would have a better chance of surviving their first year like they do in the 48 countries that have a better infant mortality rate than we do? Exactly who is opposed to this? You'd have to be a bit…crazy.
And that, I've come to believe, is the true divide in this country. It's not blue state vs red state, liberal vs conservative, Democrat vs Republican. The split we have in America can be boiled down in its simplest form to this: On one side are the people who believe Adam and Eve rode on dinosaurs 6,000 years ago – and then there's everyone else. On that first side are the people who've been fed a diet of fear and lies and hate. And who is feeding them? The 1%. The richest people in the country, the ones who aren't done with us yet because they still don't have enough wealth, have done their best to dumb down the population through destroying our educational system and using media to provide them with a vastly distorted sense of reality. The rich's only obstacle is that they only hold 1% of the votes in the country. So they have to try to get a slim majority of Americans to vote their way. And fear, plus keeping them stupid, usually works.
So that's the battle ahead of us: Organizing and mobilizing the majority of Americans to push for true universal health care, Medicare for All. At one time, back in Illinois, that was the position held by Barack Obama. He will not make this happen on his own. He will only be able to do it when the mass of American people rise up and demand it. Demand it. Why not start tonight?
Five years ago this week, my health care documentary, Sicko, opened in theaters across the country. I have spent the better part of the decade on this issue, and for me, personally, fully aware of the current law's limitations, I am very happy with today's news – not because of its specifics or nuances, but because it is a road sign, and that sign points in the correct, humane and sane direction. THAT makes this a great day.
P.S. To learn more and get involved in the campaign for real universal health care – to complete the job that's been started – get in touch with National Nurses United and Physicians for a National Health Program.

This demonstrates how important it is not to get hacks on the Supreme Court, because they are there for life and can plunge the country into a generation or more of the wrong path that will drag us down and possible out.
We need a way to get these 4 off the court, and a way to get the next partisan whomever off the court quicker than waiting until the whole country is falling apart, because some of these things set in motion are like an supertanker, nothing can stop them on a dime, and like a supertanker they can toxify wherever they go.
That said, I am happy Obama won, but I am far from satisfied in "Obamacare". I predict the numbers of un-insured will continue to grow, and the costs of health care and medical insurance will continue to increase, and the too big too fail mentality, which brought us Obamacare to begin with is deeply rooted in our economy, culture, government - as much as the people … remember the people anybody … do not like the idea of corporate personhood and too bit to fail.
Thanks to Chief Justice Roberts for focusing on the law.
Throughout all of this the entire Obamacare debate revealed on glaring truth: many in this nation are quite selfish and evil, and do no care about the health or safety of the rest of us.
He, like thousands like him will enjoy his "ObamaCare", just like he enjoyed his extended unemployment benefits last year.
Oh yes, don't forget the one about Obama being a Muslim.
if i had a neighbor like THAT, i'd consider moving ...
Actually, the National Guard is part of the standing Army, not the militia envisioned by the Founding Fathers. But nor is the Tea Party. The Militia envisioned was a "home guard" of armed civilians, trained and regulated by the Government.
That is the key, asbpab1966. "A well regulated militia being necessary to the security of a free state, the right of the people to keep and bear arms shall not be infringed."
When I hear the half-informed infer the question, "What part of "...shall not be infringed." don't you understand?" I respond, "What part of "...well regulated..." don't YOU understand?"
Scott's arrogance and resulting inaction makes him appear most ignorant. Let's remember this when he's up for re-election.
I haven't heard much pretending that "everything is rosy." Everyone knows this is not the health care reform many of us wanted, but any thinking, reasonable person can see that it is a good starting point for ONGOING reform to health care in America. As Moore says, it's worth celebrating because of the good it DOES do (reread his third paragraph for a list of some of the positives). That does NOT mean we sit on our hands and stop working toward what we really need: single-payer for all.
But until we achieve that, this is a damn sight better than what we had!
China, Vietnam, Japan, Mexico, etc. are not the ones that are killing us but companies like WalMart that think bottom line is more importanant than the USA.
Japan has had universal health care since 1961, Mexico has plans to provide universal coverage, China approved a plan in 2009 and Vietnam is aiming for universal coverage by 2014.
The opposite of what you say is true. Placing the burden of health care entirely on corporations makes us less competitive.
We lost a Toyota plant to Canada despite the low wages they can pay in the Southern US. Health care was one of the reasons they chose Canada, the expense of training illiterate US workers was another.
A sick population does not create a productive workforce or prosperous consumers, and certainly not a healthy nation.

And while I agree there is a certain amount of chauvinism the third world is not the same as the first world. People everywhere are human beings but those unlucky enough to be born in the third world have even less to say about things in their countries, at least for the moment, than we do in our … first world countries.
The politicians always killed off a national health system.
I am not a man who praises Obama but this man managed to break the circle jerk the Republicans created to do nothing while people died. Rich baby killers like Glenn Beck still say "no surrender." They have become like the segregationists pining away for not having a Colored Waiting Room to watch. Now they talk armed uprising over their grand kids having a chance of wellness.
Roberts always was a sharp logician and good writer. Now he's put those skills to good use. He seemed in the past incredibly detached from "empathic" expression. He's used that same detachment to see the larger view here, in redeeming his record on the court.
The following are reasons why the Obamacare decision is a disaster for America.
#1 According to this elitist Supreme Court, the federal government has the power to force you to buy private goods and services. What else will we be forced to buy in the future?
#2 The IRS is now going to have the power of penalizing millions of poor Americans that do not have any health insurance.
#3 Obamacare imposes more than 20 new taxes on the people, already now poor because of this government.
#4 "Death Panels" will be enacted to determine who lives and who doesn't! It's in the law, stupid.
#5 Obamacare has already forced the cancellation of dozens of hospitals.
#6 Thanks to Obamacare, you will have to wait much longer to see a doctor. Just look how Romneycare was implemented in Massachusetts
#7 Obamacare is going to send health insurance premiums soaring.
#8 Obamacare is going to result in a far bigger and oppresive federal government.
#9. Illegal aliens will be covered, who have no business in our county.
I'm stopping here as I'm out of space.
People who have no money...will not pay for insurance and still keep us paying for it...and Hospital Boards will keep paying themselves and Insurance and Lobby etc.
Next you will say Obama cancelled TV Dinners...Hospi tals cancelled themselves because of lawsuits, because of Bad Policy and Really Bad, Greedy Board of Directors and Doctors.
We have been forced to buy things all along, like duh. Not quite gestapo style but lots of choices have gone astray since sixties...where have you been Certainly not marching with us.
Death Panels...wow when were you at a
Asylum, a Nursing Home....where have you been?
Democrats if they have a brain left can cap Insurance and should.
Illegal aliens...Indian s believe that of us.....
If you do not like where Government is going than let us say we need to Organize. Start in your family, friends, community...or just sit there like everyone else has since the late 70's. Your choice...I just don't like eating Sand
Another reason to keep people dumb. They just never recognize the truth unless they suffer a loss and can't hire legal help!
Apparently you are one of those loudmouths who enjoy spouting off but do not offer one shred of the validity of anything you say. Where is your proof that any of your statements is accurate? Where are your links to legitimate news or research articles offering such proof? And I am NOT talking about right-wing non-news sites such as FAUX.
You can't back up your claims, so stop spreading your poison around.
#4, that ridiculous "death panels" bugaboo! Don't you realize that we have already had death panels for a very long time? They're called insurance companies! If you aren't aware of that fact then consider yourself blessed because neither you or your loved ones have spent enough time hospitalized to know it as the truth.
That's because you double spaced. Hmmm.
program from which I benefit rolled into a national program that serves all, including the so-called 'illegals' whose legacy was taken from then via the Treaty of Guadelupe Hidalgo in 1848. I an not willing to have individuals with communicable diseases walking among the population when medical care is available.
So, if you are a veteran contact PNHP soon, They are waiting for you.
I find this hard to believe.
May I ask which military you served in? Was it with the Soviets or with the Cubans? Or perhaps you served under Mao in China? How could any American VETERAN, who took an solemn Oath of Allegiance to OUR COUNSTITUTION be so naive as to think that TREASON TO HIS COUNTRY and her people was patriotic?
It seems to me that you have a little explaining to do.....
Hep C can be cured in many circumstances.
We should start paying attention because USA has it in all its lovely stages. Children have it from parents and drugs.
But it can come from anyone who has ever traveled, anyone who has ever shared a razor. Want information go to Hepatitis Central, Philzone. There are groups around the world set up for awareness.
Hep C is nothing to be ashamed of, it is something to fight. Make Veterans aware, get education on this disease...it is not going away.
Thanks againfor the site
We shake our heads when we see how people can live with hernia's or die from appandacits or diabetics can't afford care.
Seems some here think it is a 3rd world and parrot the GOP BS about Cuba, China etc..well woodpeckers Australia,(My country)Canada, United Kingdom,(Englan d for the thick) France, Germany all developed democratic 1st world nations not comminist or 'God dame Socialist" Nations have universal health coverage (Free medical for all.) And no one dies because they can't afford medical help!
We call folks who sprout the GOP line NUTS!and the TEA BAGGERS raving loonies and yes we also have some free psychiatric care as well.
Michael, This is true! You can't reach people with truth because they have been brainwashed. Living in a red state, I see two classes of Republicans. Defined by class-wealth-ig norance. People filled with hatred, brainwashed by the wealthy and wannabes who manipulate for selfish reasons. The wealthy: Their reasons have nothing to do with fear. Socialism labeling is only a tool. The wealthy have cause for wanting control. Helping their fellowman is anathema to them. Our red state good old boys shooting selves in foot? Many can no longer think for themselves have little wealth to worry about losing to socialism. They ARE sitting around polishing their guns, parroting the GOP mantra without comprehending how they are being used by it. Controlling wealth, using people to gain their vote, keeping the population too dumb to recognize truth, these are Republican goals. Letting dummies pay the higher % of taxes, laughing all the way to bank? Yes! The dummies? At the base of their angst: Fear, racial bias is being played to.
Let us hope that a merciful Fate removes some of the aging barnacles on his side,
so that Obama can appoint human beings.
Yes, you need to hold your nose and vote for the lesser of two evils. Our country is at stake!!! Maybe he will grow a pair in his second terms.
Meantime, whether you're religious or not, pray for the health of Ginsburg.
