Court Rules Texas Can Cut Aid to Planned Parenthood

federal appeals court ruled Tuesday that Texas did not act unconstitutionally when it moved to expel Planned Parenthood from a health and contraceptive care program for low-income women.

The ruling overturned a preliminary injunction, issued in April by U.S. District Judge Lee Yeakel of Austin, that banned Texas from enforcing rules designed to exclude Planned Parenthood from the Women's Health Program. Yeakel found that the regulations violated the organization's rights of free speech and association.

The 5th Circuit Court of Appeals, however, sided with Texas late Tuesday - ruling that the state had the authority to prohibit Women's Health Program money from going to health care providers that promote abortion or affiliate with organizations that perform or promote abortions.

Officials said Texas will act promptly to drop Planned Parenthood from the program.

"We appreciate the court's ruling and will move to enforce state law banning abortion providers and affiliates from the Women's Health Program as quickly as possible," said Stephanie Goodman with the state Health and Human Services Commission.

The program - which provides screenings for cancer, hypertension, sexually transmitted infections and other conditions - is primarily designed to provide birth control to women who would be covered by Medicaid if they were to become pregnant.

Planned Parenthood has been the program's largest provider, serving more than 40 percent of about 130,000 uninsured patients who are seen annually.

The program does not pay for abortions, and participating Planned Parenthood clinics do not perform the procedure. But because the organization is the nation's leading provider of abortions and is a vocal advocate for abortion rights, Gov. Rick Perry and Republicans in the Legislature have worked to cut off its state money.

Perry praised the ruling as "a win for Texas women, our rule of law and our state's priority to protect life."

Planned Parenthood leaders plan to meet with lawyers today to decide on the next course of action.

The organization, which received nearly $13 million in reimbursements from the Women's Health Program in 2010, had warned that losing the money could result in closed clinics and layoffs.

The organization will work to make sure that does not happen, said Cecile Richards, president of the Planned Parenthood Action Fund.

"We won't let politics interfere with the health care that nearly 3 million people a year rely on Planned Parenthood for in Texas and around the country," she said.

Tuesday's ruling is the latest development in a long-simmering controversy that reached a critical point in February when state health officials unveiled new rules that would exclude Planned Parenthood.

The U.S. Department of Health and Human Services told Texas to begin phasing out the program, which receives about 90 percent of its funding from the federal government, because it said Texas violated a federal law requiring that Medicaid recipients be able to choose any qualified provider willing to provide a service.

Instead, Perry vowed to continue the $33 million-a-year program with state money that would be free of federal mandates. The Texas-run program is set to begin Nov. 1.

Okay, Gov. Perry, I'm a Texan, tell me EXACTLY how this is a win?

Sounds to me that between now and Nov 1 (when your pretend program WON'T take effect because - surprise - you won't have the money) poor women don't have access.

Explain to me how that is a win?

Explain to me again how Planned Parenthood violated the rule of law? So far you have made a lot of noise, but facts you've been a little short on.

You REALLY hate to take government money yet you balanced the 2010 budget WITH STIMULUS money.

But 2012 is another problem. We have a $27 BILLION dollar deficit? Planning on whining to Obama for more stimulus money? How do you plan on creating a $33 million a year program when you just don't have the cash? Wishful thinking? Even the 9.4 Billion rainy day fund STILL leaves you short.

Perry is lying. There won't be anything to replace Planned Parenthood. Jobs will be lost.

All so HE can stay true to his ideology.

Tell me again how this is a "win" for women? Perhaps in your own twisted world, ideology solves everything. But those of us in the real world have to see doctors.

Along with the outcry, there's the silence- which is sometimes loudest.

Where are all the powerful women w/the means to speak on this 21st century assault on us? Where's Oprah, Michelle, Hillary, Whoopi, Madonna or even Martha? Even if any or all the aforementioned women are "pro-life," that shouldn't matter. "Pro-life" can only be attained w/a healthy body & women denied access to healthcare, because they cannot afford it, lose that right; "pro life" isn't a one womb cause.

Where are all the women fighting for the rights of women to have as much medical care afforded them as Viagra? Where are all the women in the public eye whom we taut as "hero's" for "making it" in a "mans" world?

If I could go back in time, I'd go back and apologize to Margaret Sanger; Susan B. Anthony; Elizabeth Cady Staton; Lucy Stone & all the women who fought for us.

Too many women have so little voice and what is left is being scorned, ridiculed & raped before our eyes- and all those independent & powerful women of fame & wealth who say nothing, allow men like Rush, Todd Akin & Rick Perry get away with this insidious hunt for women to target as witches, so they can burn them at the stakes of their public trials.

The result of stopping Planned Parenthood from helping women space their children may be an increased birth rate for children in poor families. How is that good for Texas?
